LIABILITY WAIVER AND HOLD HARMLESS AGREEMENT

The individual member, on behalf of himself/herself, his or her heirs, executors, administrators, assigns, or personal representatives, hereinafter collectively "individual member," releases and forever discharges the Murfreesboro Pickleball Association, Inc., a Tennessee charitable corporation, its affiliates, officers, directors, members, agents, staff, volunteers, heirs, representatives, successors, and assigns, collectively, the "Released Parties," from any and all liability, claims, demands, actions and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by the individual member, or to any property belonging to the individual member, whether caused by the negligence of the Released Parties, or otherwise, while participating in such athletic and related event activities, or while in, on or upon the premises where the activities are being conducted.

The individual member is fully aware of the risks and hazards connected with any activity the individual member may participate in that is sponsored by or facilitated by the Released Parties, including the risk of injury to the individual member's neck, back, spine, knees or other parts of the body, and individual member hereby elects to participate voluntary in said activity, and to enter the premises used to conduct said activity, including, but not limited to games, training, leagues, and tournaments knowing that the activity may be hazardous to the individual member's person or property. The individual member VOLUNTARILY ASSUMES FULL RESPONSIBILITY FOR ANY RISKS OF INJURY OR LOSS, INCLUDING, BUT NOT LIMITED TO, PROPERTY DAMAGE, PHYSICAL INJURY, PSYCHOLOGICAL INJURY, PAIN, SUFFERING, ILLNESS, DISFIGUREMENT, PARALYSIS, ECONOMIC, AND/OR EMOTIONAL LOSS, WHETHER SAID INJURY OR LOSS IS TEMPORARY OR PERMANENT, INCLUDING DEATH, that may be sustained by the individual member, as a result of being engaged in such an activity, whether caused by the negligence of the Released Parties or otherwise. The individual member further hereby agrees to indemnify and hold harmless the Released Parties from and against any loss, liability, damage or costs, including court costs and attorney's fees, that they may incur due to the individual member's participation in the proposed activities, whether caused by the negligence of the Released Parties or otherwise. The individual member agrees that this Waiver of Liability and Hold Harmless Agreement shall be construed in accordance with the laws of the State of Tennessee. The individual member acknowledges full, adequate and complete consideration and intends to be bound by the terms contained herein.

INDIVIDUAL MEMBER HAS READ THIS WAIVER OF LIABILITY AND FULLY UNDERSTANDS ITS TERMS, AND AGREES TO BE BOUND BY IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
